Terms of sale

Last updated:

This English version is provided for information purposes only. In the event of any discrepancy, the French version shall prevail.

These terms of sale apply to takeaway orders placed on the bonmi.fr website, then collected and paid for at the restaurant (“Click & Collect”).

1. The seller

Orders are concluded with Bonmi, a French SAS with share capital of €3,000, registered with the Paris Trade and Companies Register (RCS) under number 991 768 888, with its registered office at 73 rue Pernety, 75014 Paris, France.

  • Phone: +33 1 40 44 71 42
  • Email: bonmi75014@gmail.com

Full details about the website publisher are given in our legal notice.

2. Purpose and acceptance

These terms apply to consumers, that is, natural persons acting for purposes outside their trade or profession.

They are available on the website at all times, and in particular before any order is placed. By confirming an order, the customer acknowledges having read and accepted them. The applicable version is the one in force at the time of the order.

3. Products

The dishes offered for takeaway are a selection from our menu. Their ingredients and number of pieces are shown on the order page.

No alcoholic drinks are sold online.

Allergens

The 14 regulated allergens (Regulation (EU) No 1169/2011) contained in each dish are shown on the order page, before the order is confirmed.

Our kitchen handles all of these allergens. Despite our precautions, traces cannot be ruled out. If you have a food allergy or intolerance, please contact us before ordering.

Storage

Our dishes contain raw products, in particular fish. They must be kept cool and eaten soon after collection.

4. Prices

Prices are shown in euros, including all taxes (VAT included). The applicable price is the one displayed on the order page when the order is confirmed. The total amount is shown again on the confirmation screen and in the summary email.

An online order is limited to €119 and 15 items. For a larger order, please contact us by phone.

A receipt is provided on collection.

5. Ordering

Availability

Online orders can be placed during service hours, Monday to Saturday, lunch and dinner, for the current service only. An order is only accepted if it can be ready before the kitchen closes.

Steps

  1. The customer chooses dishes and quantities. The basket can be changed at any time before confirming.
  2. The customer enters their name, email address and phone number.
  3. The customer confirms the order by clicking the “Order — pay on collection” button. This click commits them to paying for the order on collection.
  4. A confirmation is displayed on screen, with an order number and an estimated pick-up time. A summary is sent by email.

The contract is concluded when the confirmation is displayed. It is concluded in French or English, depending on the language chosen on the website.

The summary email serves as the record of the order. We advise the customer to keep it.

6. Payment

Payment is made at the restaurant, on collection, by card, in cash or with meal vouchers (titres-restaurant, within the limits set by the applicable regulations).

No payment is requested online, and no bank details are collected on the website.

7. Collection

The order is to be collected at the restaurant, Bonmi, 73 rue Pernety, 75014 Paris, from the pick-up time given in the confirmation. This time is an estimate, set at about 30 minutes after the order.

At the counter, the customer gives their order number. We invite the customer to check their order on collection.

The order is kept for 15 minutes after the estimated pick-up time. After this time, unless the customer has told us they are running late, the order may no longer be handed over: for hygiene reasons, raw products cannot be kept any longer.

If orders are repeatedly not collected, Bonmi reserves the right to no longer accept online orders from the same customer.

8. Cancellation

By the customer

The customer may cancel their order by phone, on +33 1 40 44 71 42, within 5 minutes of its confirmation. After that, preparation has started and the order can no longer be cancelled.

By the restaurant

Bonmi may have to cancel all or part of an order when it cannot be prepared (missing product, kitchen incident). The customer is then informed as soon as possible, by phone or email. In the event of a partial cancellation, we offer the customer the choice of keeping the rest of the order or cancelling it entirely.

9. No right of withdrawal

In accordance with Article L221-28 4° of the French Consumer Code, the 14-day right of withdrawal that applies to distance sales does not apply to orders placed on the website, as they concern goods liable to deteriorate or expire rapidly.

10. Complaints

Any complaint about an order may be sent by email to bonmi75014@gmail.com, within 24 hours of the order. To help us deal with it quickly, please give your order number, the date and a description of the problem, with a photo if possible.

This time limit is only intended to allow us to check the complaint quickly. It does not deprive the customer of their statutory rights, in particular the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code).

11. Consumer mediation

In the event of a dispute, the customer first sends a written complaint to Bonmi, as described above.

If no satisfactory answer is received, the customer may refer the matter, free of charge, to the consumer mediator Bonmi has joined, in accordance with Articles L612-1 et seq. of the French Consumer Code:

12. Personal data

The data provided when ordering (name, email, phone) is used solely to process the order. How it is processed, how long it is kept and the customer’s rights are described in our privacy policy.

13. Governing law and disputes

These terms of sale are governed by French law.

In the event of a dispute, a consumer customer may bring proceedings, at their choice, before the court of the place where they lived when the contract was concluded or where the harmful event occurred, or before any other court with jurisdiction under the law.
